Licensing of Private Investigators

Within the next two years regulations will be put into place that will require all Investigators to apply and pay for a licence. It will be an offence to work without a licence. The criteria for granting the licence has yet to be determined i.e. the licence may be granted after an interview and a written examination. Proof of relevant Experience may be taken into account. It is not anticipated that anyone with a criminal record will be granted a licence.

In September 2008 the Security Industry Authority (SIA) has published an interim Impact Assessment, which contains further information about the Government's proposals to license private investigation activities. The interim Impact Assessment confirms' Ministers' intention to develop competency-based licensing, subject to the agreement of the necessary Orders by Parliament.

The interim Impact Assessment is available on the SIA website: http://www.the-sia.org.uk/home/about_sia/publications/publications_ria.htm

The Home Office will publish the final Impact Assessment at the same time as the relevant Orders are laid before Parliament.
